Important Update – 50% Remission on ACT Lease Variation Charges for Eligible Developments

We would like to make you aware of a recent announcement in the ACT Government's 2026–27 Budget that may benefit some current and future development projects.
As part of measures to encourage the delivery of missing middle housing, the ACT Government has introduced a temporary 50% remission of the codified Lease Variation Charge (LVC) for eligible developments in Suburban (RZ1) and Suburban Core (RZ2) zones.
Who may be eligible?
The remission applies to developments that:

Have not paid or deferred their Lease Variation Charge as at 10 June 2026;

Receive Development Approval (DA) before 30 June 2029; and
-
Complete construction by 31 December 2030.
What does this mean for existing approvals?
Based on the information currently available, there is a possibility that the remission may apply to some developments that have already received DA approval, provided the Lease Variation Charge had not been paid or formally deferred as at 10 June 2026.
However, developments where the LVC has already been deferred (for example, until after construction is completed) may not be eligible. We recommend reviewing your specific circumstances before making any assumptions regarding eligibility.
Temporary Measure
Please note that this is a temporary initiative. Only developments that obtain Development Approval on or before 30 June 2029 will be eligible to access the remission, subject to the Government's eligibility requirements.
